Privacy policy

This Privacy Policy explains how Eva Caravan processes the personal data of people who visit the website evacaravan.com (the "Website"), buy on it or contact us. It has been drawn up in accordance with Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), Spanish Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD) and Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).

2. What data we process

  • Identification and contact data: first name and surname, email address, telephone number, delivery and billing addresses and, where applicable, tax ID and company details.
  • Order data: products purchased, amounts, delivery option, purchase history, returns and incidents.
  • Payment data: payment method used and payment confirmation. Your full card details are processed directly by the payment providers; Eva Caravan does not store them.
  • Your customer account data, if you create one.
  • Communications: the content of your messages by email, form, chat or telephone.
  • Reviews you publish about our products.
  • Browsing and device data (IP address, browser, pages visited, interactions), collected through cookies and similar technologies according to your preferences. See our Cookie Policy.

We do not process special categories of data. If you do not provide the data marked as mandatory in a form or during checkout, we will not be able to deal with your request or process your order.

3. Purposes and legal bases

  • Managing your orders (payment, preparation, shipping, returns, guarantees and incidents) and your customer account. Legal basis: performance of the contract (Art. 6(1)(b) GDPR).
  • Issuing invoices and complying with accounting and tax obligations. Legal basis: legal obligation (Art. 6(1)(c) GDPR).
  • Responding to your enquiries and requests, including requests to register as a trade customer. Legal basis: steps taken at your request prior to entering into a contract or, where applicable, your consent (Art. 6(1)(b) and 6(1)(a) GDPR).
  • Sending you marketing emails if you subscribe. Legal basis: your consent (Art. 6(1)(a) GDPR). If you are already a customer, we may send you offers for products similar to those you bought, in accordance with article 21.2 of the LSSI-CE; you can object at any time using the unsubscribe link included in every email.
  • Asking for your opinion on the products you bought and publishing the reviews you send us. Legal basis: legitimate interest in knowing our customers' satisfaction (Art. 6(1)(f) GDPR) and, for publication, your consent.
  • Analysing the use of the Website and measuring and showing advertising (for example, with Google Analytics and Google Ads). Legal basis: your consent, which you give or refuse in the cookie banner (Art. 6(1)(a) GDPR).
  • Preventing fraud and ensuring the security of the Website and of payments. Legal basis: legitimate interest (Art. 6(1)(f) GDPR).

We do not take decisions based solely on automated processing that produce legal effects concerning you, except for the automatic fraud checks that payment providers carry out on each transaction.

4. How long we keep your data

  • Customer and order data: for as long as the business relationship lasts and, afterwards, for the legal retention periods (in particular, six years for commercial records and the limitation periods for tax and liability purposes, including the product guarantee).
  • Enquiries: for as long as needed to answer them and, afterwards, for up to one year, unless they lead to a business relationship.
  • Marketing emails: until you unsubscribe or withdraw your consent.
  • Cookies: the periods indicated in the Cookie Policy.

Once these periods have expired, the data is deleted or anonymised.

5. Who we share your data with

We do not sell your data. We only share it with third parties when necessary for the purposes above or when required by law:

  • Shopify (Shopify International Limited, Ireland), the e-commerce platform that hosts the Website and processes orders, as data processor.
  • Payment providers that handle the payment method you choose (for example, the card payment gateway, PayPal or Klarna).
  • Carriers (GLS, UPS, Ontime and DB Schenker) and the shipping and returns management platform, to deliver your order and process returns.
  • Google (Google Ireland Limited), for web analytics, advertising and listing our products on Google, within the scope of what you have accepted in the cookie banner.
  • Judge.me, a customer review management platform.
  • Providers of chat, email and accounting, tax and legal advisory services that work for us.
  • Banks, the Tax Agency, courts and other authorities, where required by law.

6. International transfers

Some of these providers, or their sub-processors, may process data outside the European Economic Area (for example, in Canada or the United States). In such cases, the transfer is based on an adequacy decision of the European Commission (such as the one for Canada or the EU-US Data Privacy Framework for certified companies) or on standard contractual clauses approved by the European Commission.

7. Your rights

You can exercise your rights of access, rectification, erasure, objection, restriction of processing and data portability at any time, and withdraw your consent without affecting the lawfulness of prior processing. To do so, email us at soporte@evacaravan.com or write to the address in section 1, with the reference "Data protection". If we have reasonable doubts about your identity, we may ask you for additional information to confirm it.

If you believe we have not handled your rights properly, you can lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos) (www.aepd.es) or with the supervisory authority of your country of residence.

8. Minors

You must be at least 18 years old to buy on the Website. We do not knowingly process data of children under 14; if we find that we have received such data, we will delete it.

9. Security

We apply appropriate technical and organisational measures to protect your data. Communications with the Website are encrypted using HTTPS. If a security breach occurs that is likely to result in a high risk to your rights, we will inform you without undue delay.

10. Links to third-party websites

The Website may contain links to third-party websites, which have their own privacy policies. Eva Caravan is not responsible for their processing of data.

11. Changes to this policy

We may update this Privacy Policy to reflect legal changes or changes to our services. The version in force is always the one published on this page, with its date of update.
